How it works

Three steps, one agreement.

We do not lend against your credit record. We buy a defined portion of what you are owed at a discount, and you repurchase it when the money lands. That keeps the paperwork short and the outcome predictable.

Tell us what you're owed

Send the documents behind the receivable: the settlement or court order, the signed sale agreement, the invoice or the letter from the executor. We assess the certainty and timing of the payout, not your credit history.

Agree the capital and the repurchase price

We advance a capital amount against the receivable under a discounting agreement. The agreement sets out the rate, how it accrues and how the repurchase price is calculated, so there is nothing left to interpretation.

Repay when the money arrives

When the settlement, transfer or payment is received, the repurchase price is settled from those proceeds. You receive a statement of account showing every day's accrual to the cent.

The words on your agreement, explained.

Every Fairbank agreement and statement uses the same handful of defined terms. If you understand these four, you understand the whole arrangement.

Capital Amount
The sum we advance to you on the date the agreement is signed and paid out.
Annual Rate
The rate agreed in your discounting agreement. It is expressed as a nominal annual rate, divided into a monthly rate and applied daily to the running balance.
Days Elapsed
The number of days between the date the capital was advanced and the date it is repaid. You pay only for the days the money was actually with you.
Repurchase Price
The capital amount plus the interest accrued over the days elapsed. This is the single figure that settles the agreement in full.

How much can I get?

That depends on the size and certainty of the receivable. We advance a portion of what you are owed, not the full amount, so that the repurchase price is comfortably covered when the money arrives. Tell us the figure and the source and we will give you a clear answer.

How quickly is the money paid out?

Once we have the supporting documents and the signed agreement, payment is usually made within a few working days. Straightforward matters with complete paperwork move fastest.

What if the payout is delayed?

Interest continues to accrue daily until the repurchase price is settled, exactly as set out in the schedule. There is no separate penalty for a delay that is outside your control; you simply pay for the extra days.

Do I need to change my attorney or agent?

No. Fairbank works with claimants, sellers and businesses regardless of who their attorney, agent or accountant is. Where your own attorney holds the proceeds, we simply arrange for settlement of the repurchase price from those funds.

Is my information kept confidential?

Yes. The documents you send us are used only to assess and administer your agreement, and are handled in line with the Protection of Personal Information Act.
